Our business disputes team is led by Parminder Kaur Mattoo, herself a successful partner who has contributed substantially to our firm’s success.  Her team is committed to using alternative dispute resolution methods such as negotiation and mediation to resolve commercial disputes.  These processes are faster and less expensive than litigation.  However, if going to Court is unavoidable, you can be confident we will have a clear strategy for procuring a successful outcome.

How can I fund commercial litigation?

Going to court carries risk and many businesses do not have the cash reserves to fund litigation, even though they may have a valid claim.  We can advise you on obtaining litigation funding from a third-party funder if your case qualifies.  Many funders now have solutions for smaller value claims and utilising these mitigate your risk of pursuing commercial litigation.

Can I recover all my litigation costs if I win my case?

Even if you are granted 100% costs recovery (which in practice never happens) on a successful civil litigation claim, there are costs which cannot be recovered, and this mainly consists of the time taken away from your business, both physically and mentally, to deal with the litigation.  Therefore, it is imperative to factor this in when weighing up the costs associated with pursuing a claim.  As long as you have identified any possible intangible costs, you can then put in place contingency plans to mitigate them.
